@angiebaby Any party empowered to possess or distribute CSAM without consequences has an incredibly powerful chilling effect they can wield against others who might be monitoring, republishing, or archiving their publications.

@dalias @angiebaby idk, I think "the us government can possess and distribute csam, why wouldn't I be able to?" is an ironclad legal defense. Especially with this administration who seems to use whataboutism as a religion.

(To be 100% clear, I'm of the opinion that any entity possessing csam is disgusting and should be very illegal)

@rpgwaiter @angiebaby "Why wouldn't I be able to?" isn't even the question. I'm presuming none of us would want to. But the idea that, by being vigilant of what our government is doing and archiving their document releases, we might find ourselves in possession of CSAM is very upsetting and would probably discourage a lot of folks from doing that. Even before we get into the legal risk (which we can't trust the courts to do the right thing on). This is the "chilling effect" I'm speaking of.

@dalias @angiebaby that's fair, and is most of the reason why I haven't grabbed a torrent of the files personally

@rpgwaiter @angiebaby Yeah that's exactly what I'm talking about. I mean seeing this post for me was a "well, there went any chance I had of keeping a local archive of this stuff". 🤬
