I think that the careless, abusive, and harmful "gathering" practices need to be challenged as misuse of other's computing resources and the "distributed denial of service attacks" that they, in effect, are.

Yes. Any "direct quoting" of copyrighted works, as text files on a disk, for example, would > only be a bunch of numbers < too. ASCI, Unicode, UTF-8, etc. are ways of encoding text into numbers, and displaying text representations (glyphs) of them later.
So LLMs hold "indirect" and maybe "abstract" (or not) numbers related to the copyrighted works. Not sure how that will or should work out, from a legal perspective.
"Our agents did domesticate the local apes and are using them as slaves. Our agents can pretty much walk into any of the native's dwellings, demand service, and get it. We can purrrty confidently call it 'conquered,' and under our control."

"That darned 'Constitution' thing!
It's always been such a barrier and a problem for us!"
I don't think that will do it either.
I'll just be over here, staring into the heart of the Tardis.
We shouldn't really need to see the files, given the testimony of people who were victims of the events.
The TSA has not actually been able to present any compelling evidence that they have prevented any terrorist attacks. All they can conclusively show is that they have taken a great many things from travelers, most of which are demonstrably harmless. They also routinely fail their own tests -- missing weapons hidden in luggage that they are supposed to be stopping.
It is theoretically possible for them to do a much better job. But not likely, regardless of budget.
