Yes, both, but also, remembering which key sequence I programmed to do the em-dash turned out to be too hard, to I just use an ordinary dash and spaces and hope readers interpret that appropriately

The courts will likely take VPN use as a compounding factor that showed clear and intentional acts to subvert justice and break the law.

Using a VPN is also detectable, and would be like waving a flag that says, "hey, come check me out"
